South Bend man accused of disturbing behavior

The South Bend and Raymond police departments arrested a South Bend man after a victim came forward and informed the Crisis Support Network in Raymond that she was potentially sexually assaulted last year.

According to the victim, she was dropped off at her South Bend apartment around June 8, 2023, and was heavily intoxicated. As she was walking to her apartment, she contacted two relatives.

“[The victim] advised that she was outside speaking with [her relatives] and was having a hard time keeping her balance,” investigating SBPD Officer Eric Fuller stated in court records. “[She] advised that she was outside stumbling around and was contacted by [SBPD Sgt. Luis Gonzalez] and assisted her to her apartment.”

The victim resides in an apartment shared with her mother and her mother’s boyfriend, Jorge A. Alvarez, 35. The victim alleges that she remembered being inside the apartment but woke up the following day without recollection of what had transpired.

Days later, according to court records, the alleged victim was reportedly asked by Alvarez, “You don’t remember what happened that night?”

“[The alleged victim] advised me that he mentioned to her that he had a video, and not to tell her mother as she did not want to lose his girlfriend and their two small children in common,” Fuller states in court records. “[The alleged victim] advised me that she asked [him] to leave her alone.”

The alleged victim also claimed that another incident transpired on Aug. 16, 2023, when she reportedly woke up and found Alvarez in her bed. Alvarez allegedly said, “he heard someone outside of her bedroom window and came to check on her.”

She also allegedly discovered oil on her body.

According to court records, Alvarez admitted to “accidentally” dropping oil onto the alleged victim and “taking a video of [the victim] while she slept in her bedroom naked.” He reportedly deleted the video so that his wife would not discover it.

Alvarez was arrested and booked into the Pacific County Jail and made a preliminary appearance in Pacific County Superior Court on Monday, April 22. Judge Donald J. Richter set his bail at $100,000, and he is scheduled to be formally arraigned on Friday, April 26, for one count of voyeurism and one count of fourth-degree assault with sexual motivation.
