SOUTH BEND — The following cases highlighted the Dec. 6 Pacific County Superior Court felony docket.

Sarah M. Marcus, 38 — Hours before a scheduled court appearance, she was able to post $10,000 bail with a bonding agency but failed to show up for her hearing. A-Plus Bail Bonds posted her bond.

Allegedly, she immediately resumed the behavior that led to her arrest in the first place. Neighbors called 911 on Nov. 27 after learning where their stolen dog was — and an officer further learned Marcus had reportedly been terrorizing neighbors for months, including spreading dead rats on a property.

According to court records, Pacific County Superior Court Judge Donald J. Richter issued a no-bail warrant for Marcus’s arrest following her failure to appear in court. A new case filed on Dec. 9 details some of the chain of events following her release and then re-arrest.

“On Dec. 7, 2024, I responded to a report of a possible court order violation and threats made by Sarah Marcus against [an alleged victim],” Pacific County Sheriff’s Office Deputy Dustyn Akker states in court records. “According to [the alleged victim], on the evening of Dec. 6, 2024, she attempted to contact [another woman].

“When she messaged [the woman], it appears Sarah Marcus either took possession of the phone or was already using it. During the message exchange, Sarah identified herself as the sender on multiple occasions [and] made a threatening remark to the effect ‘Your turn to die, b****…..,” Akker added.

Marcus was subsequently located and taken into custody. She is now being held without bail.

Erick L. Garrett, 44 — He pleaded guilty on Sept. 27 to an amended charge of attempted delivery of a controlled substance. He was initially facing multiple drug charges in connection to a 2022 traffic stop in which officers found a substantial amount of fentanyl ready for sale.

According to court records, Garrett faced a standard range of 0 to 90 days in jail, with an offender score of 3. The Pacific County Prosecutor’s Office recommended that he be sentenced to two months in jail and 12 months of community custody. Judge Richter accepted the sentence and recommendation.

Garrett has previous convictions, including a most recent 2023 case for third-degree assault and two cases dating back to 2005 for two separate counts of second-degree assault.

In coverage of the Sept. 27 criminal docket, the Observer correspondent who covered the court incorrectly stated Garrett had already been sentenced. Garrett’s sentence was set over to Dec. 6 at the time.

Tegan L. Tipler, 43 — The prosecutor opted to amend his charges to just one count of first-degree unlawful possession of a firearm and to dismiss two other counts. Tipler is accused of trespassing onto a property and illegally hunting, including while in possession of a firearm. He was caught by the Washington State Department of Fish and Wildlife on Sept. 15.

According to court records, Tipler is scheduled to be formally arraigned on Dec. 20, and no trial dates are currently set. He has a felony record dating back to the late 1990s. He has previous convictions that include attempting to elude law enforcement, violation of a protection order, vehicular assault, theft of a firearm, and third-degree assault.

William C. Baillie, 45 — He is one of two alleged suspects who allegedly broke into an old shop off of U.S. 101 outside of South Bend on Feb. 6. He was charged with second-degree burglary. Following a change of venue motion, his case is being moved outside of the area and will now be held in King County.

No additional details were immediately available. His co-defendant, Scott D. Reeder, 56, was found incompetent to stand trial and is currently receiving restoration services at Western State Hospital in Lakewood.

No trial date is scheduled in either case.

John F.N. Connery, 35 — He appeared for his arraignment following being arrested on Nov. 26 for allegedly violating a no-contact order and stalking a woman. Connery was convicted less than a year earlier for stalking the woman.

He entered a plea of not guilty, and his pretrial hearing was scheduled for Dec. 20, trial confirmation hearing on Jan. 17, 2025, and his trial dates are tentatively set for Jan. 29-30, 2025.
