NOTICE OF PUBLIC HEARING TO CONSIDER FORMATION OF THE NORTH BEACH WATER DISTRICT

NOTICE IS HEREBY GIVEN that the Board of Pacific County Commissioners will hold a public hearing on the 9th day of October, 2007 at the hour of 10:30 a.m., or as soon thereafter as possible, for the purpose of considering a petition that has been presented for the formation of a Water District with the boundaries described below:

Beginning at the Mean High Water Line of the Pacific Ocean and the Westerly extension of the centerline of 295th Street, Section 20, Township 12 North, Range 11 West,

Hence Easterly following the centerline of said 295th Street, to the intersection of the centerline of “O” Street, Section 21, Township 12 North, Range 11 West,

Hence South following the centerline of said “O” Street to the south line of the Northwest 1/4 of the Northwest 1/4 of said Section 21, Township 12 North, Range 11 West,

Hence East following the said South line to the East line of said Section 21, Township 12 North, Range 11 West,

Hence North following said East line to the Northeast corner of said Section 21, Township 12 North, Range 11 West,

Hence East following North line of Section 22, Township 12 North, Range 11 West, to the Mean High Water Line of Willapa Bay, Section 22, Township 12 North, Range 11 West,

Hence Southerly following said Mean High Water Line of Willapa Bay to the Easterly extension of the centerline of Cranberry Road, Section 34, Township 11 North, Range 11 West,

Hence Westerly following the said centerline of Cranberry Road to the intersection of State Highway 103, Section 33, Township 11 North, Range 11 West,

Hence Westerly following the centerline of the Cranberry Beach Approach Road to the Mean High Water Line of the Pacific Ocean, Section 32, Township 11 North, Range 11 West,

Hence Northerly following said Mean High Water Line of the Pacific Ocean to the point of beginning.

In addition, notice is hereby given that an ambiguity exists on the map (dated July 26, 2006) which is attached to the petition. The legal description and boundary lines illustrated on the petition map are accurate, but an east-west boundary titled as Joe Johns Road, is actually the 1/4 section line of said Section 21. Joe Johns Road is located at the 1/2 section line of said Section 21. Copies of the map indicating the correctly titled boundary is available by contacting the Pacific County Commissioners Office located at 1216 W. Robert Bush Drive, P.O. The purpose for the creation of the Water District is to purchase, acquire, operate, and maintain public water supply facilities in order to furnish people within the District with water for all uses and purposes authorized by law. The proposed name of the District is North Beach Water District.

Any person, firm, or corporation may appear before the Board of County Commissioners and make objections to the establishment of the Water District or the proposed boundary lines thereof. If the formation of the Water District is found to be conducive to the public health, convenience, and welfare, and will be of benefit to the property included in the land described above, the Board of County Commissioners will present a resolution to the County Auditor calling for a special election to consider formation of the Water District and an election for its initial commissioners.

Interested persons are encouraged to either attend the hearing or to submit their comments in writing by October 5, 2007, to the Pacific County Commissioners Office, P.O. Box 187, South Bend, WA 98586. Email comments may be sent to knoren@co.pacific.wa.us.

This facility is “barrier free” and accessible by those with physical impairments. Aids will be provided upon request for those with language/speaking or hearing impediments, but requests need to be received at least five (5) business days prior to this hearing.
